Head Injury Compensation Award Factors

by admin on March 4, 2010

Head4Compensation claims are separated into two types, general damages and specific damages. General damages claims are supported only by the damage you endured, and your future prognosis. Specific damages wrap up everything else, taking into consideration long term effects, financial loss for you and for dependants and missed wages.

In harmful head injuries, relying on the conditions of a crash and different elements like the age of the victim and whether they have dependents, specific injuries can be many more times more than the general injuries, as they’re intended to be a financial supply for the rest of your life. It’s the specific damages figures that generally create the headlines of multi-million pound head injury compensation awards, even though the general damages in such issues are perhaps relatively small.

It’s not just the victim of a head injury that suffers. Their family will also need to conform to match the consequences. When the damaged person is well enough to be attended at home, this will include creating substantial changes to their house, like access ramps, especial bathing installations, and some space to home the several pieces of medical tool that are perhaps required as tools for their care. In special conditions a court may confirm a compensation settlement that wraps the price of moving to a house that is better suited towards the patient.

AlcoholBinge drinking is massively on the rise in the UK. 37% of all adults regularly exceed the daily recommended drinking levels, and this problem becomes much worse at a weekend. Some studies come out with about 1 in 4 people being regular binge drinkers. Many people related to the health industry are blaming the very cheap prices at which alcohol is available. In supermarkets especially alcohol is very cheap, with the possibility of buying a bottle of wine or pack of beers for much less than £5.

Another major problem is the drinks promotions in nightclubs. Alcohol Concern’s recent study into the drinks promotions and club and bars in Welsh city centres showed just how far these drinks promos have gone. They are basically promoting people getting drunk, with their flyers and posters reflecting this as the primary aim. The prices are crazy, with it being easy enough to go over the recommended daily allowance of alcohol for well under £5 again. This sort of promotion is seen as irresponsible as it leads to many more instances of drunkenness, which can in turn lead to more instances of alcoholism, making more people require alcohol detox at a clinic.

This has led to calls for a minimum price for alcohol in the UK. This would essentially make it less possible for people to get horrendously drunk without spending a large amount of money, rather than go into a club and spend £10 for an “all you can drink” promotion.

Scottish Parliament has been discussing such moves for a while, however there is currently debate as to whether this is legal in European Law so the bill has not yet been pushed through, but they are confident that if it is, a rise in alcohol prices will lead to a fall in alcohol abuse.

Health Experts Want Mephedrone Banned

by admin on February 17, 2010

meph3This is what people feel on the legal issues regarding Mephedrone. They have a concern about the low amount of information about this drug and on its risks or side effects. There hasn’t been any long term research on the drug and the main reason for this is because it has been around for eighteen months only even though scientists knew about it for a little less than 10 years. The main reason for the low amount of information on the drug is because of the speed at which it has become so famous as a recreational drug and this has surprised the health authorities quite a bit.

Since the government has not been able to understand the long term effects of this drug, the ACMD (Advisory Council on Misuse of Drugs) has been brought into the picture in order to determine the legal high’s that are linked with Mephedrone and similar other drugs. Now, lets look at the main reason why the ban by the ACMD is going to take atleast six to twelve months. The sacking of a professor and the former chairman of the committee, David Mutt, from the home office has delayed the report presentation which was supposed to be in March.

ice_slipIce and snow can be very dangerous, as all of us in the UK found out last month! It is very easy to fall and have an accident in such conditions. But whose fault is it if you do? Is it yours for walking on the ice in the first place? Is it the makers of your shoes? Or is it the council’s or land owner’s for not properly gritting the roads? This is the debate raging now amid a spate of accident claims related to the icy conditions last month.

It is possibly more difficult to get compensation from the council as there is an element of responsibility there to grit the roads, however can they be held accountable for every single bit of pavement and road? It really should be looked at on an individual case by case basis.

It is when an injury occurs on private property that an accident claim could be successful. These are easier to prove as the owner’s influence is over a much smaller area. These will be assessed on the basis of whether the owner has put in place suitable systems to ensure the safety of their visitors. This responsibility stretches to employers also, as people can make accident claims for slipping on the ice while at work just as easily as they can as a visitor to their property if the correct provisions have not been taken to ensure their safety.

Car accident claims can also be made for accidents on icy roads. This must be only if the accident was not your fault, i.e. as a result of somebody else’s careless driving. Most sensible people will slow down and drive super carefully when it is icy, but some will just carry on as normal, and this can cause accidents. Also, for passengers it is a bit more simple to make accident claims because you are not going to be at fault as you are just sat in your seat!

Your Body Mass

by admin on January 16, 2010

fat 6Everyone is concerned with their weight and we all want to do whatever possible to keep us healthy and fit. One way of finding out if your current weight is healthy for your height is to use a body mass index. By doing a few calculations you can easily find your personal BMI and check it using a BMI chart. Serious health problems can arise and strain on your heart is caused by being overweight. Other problems include: high blood pressure, heart disease, varicose veins, sleep apnea and type 2 diabetes. If we all remained within our healthy weight, over 300,000 lives in the United States alone, could be saved.  Take the time to do these calculations and find out what you should weigh, based on your height. Take you current weight and multiply it by 703, then divide that number by your height in inches. Once again, divide that number by your height in inches. That will give you your body mass index. 18.5 or below will put you in the “underweight” category. Up to 24.9 gives you a “healthy” reading and anything over that is considered overweight to obese. There are exceptions to this number. Children should be evaluated by a doctor the body builders who have more muscle, which weights more, will automatically have a high BMI number.

negligenceWhen you think about medical negligence, most people think about doctors and nurses making errors. But, medical negligence can be caused by anyone that is related to the medical profession. And, that profession extends way beyond your doctors office or a hospital.

In some cases, medical negligence has occurred even when all of the medical professionals you’ve came into personal contact with have provided the highest quality of care. You can literally be subjected to undue suffering and pain from medical professionals that you never meet.

The medical profession includes manufacturers of medical equipment, laboratories and any company that supplies medical products. If someone has made a mistake in processing your medical tests, you may be given the wrong treatments. And, if a machine such as a heart monitor is faulty, your diagnosis may go undetected.

If you feel that you’ve received inadequate medical care, you will need to find a qualified attorney. An attorney that handles these types of cases has access to investigators and other professionals that can find out exactly who is responsible for negligence. And, once there is proof of negligence, you can proceed with a medical negligence claim.

Clinical Negligence on the Increase

by admin on September 28, 2009

negligence8Figures relating to the amount of compensation paid by the NHS are on the rise. Year on year the amount of compensation paid by the NHS increases. The Conservative party has said that in the next year the amount of compensation paid is set to jump from £396 million to £713 million, that’s an increase of a staggering 80 percent.

The reason that this is so startling is because this increase will consume about a third of the extra funding that hospitals have managed to secure to improve healthcare standards.

NHS Litigation CEO, Steve Walker says that the large increase in compensation payments has come about as a direct result of the Thompstone judgement. This is the latest ruling from the court of appeal that changes the way that payments are calculated.

Statistically, more than half of the payments for compensation are towards maternity related cases. The Royal College of Midwives argues that if they received the proper amount of funding for education, the amount of claims would drop as a result.

Clinical negligence is a problem that seems to be increasing and compensation claims are consuming more and more money that should go towards training and equipment. It seems that if the correct training and equipment were available in the first place, the problem might solve itself.

Healthy diet for a healthy prostate

by admin on August 24, 2009

cialis6Being able to enjoy a healthy and active sex life definitely adds on to the overall enjoyment of life itself. And enjoying this pleasurable aspect is often right on top of most of our lists. But just as you do things to ensure good overall health or a healthy heart, it’s very important for men to protect their prostate from infection, enlargement and even cancer. This can help prolong your sexual capabilities well in your retirement.

Including lots of veggies and fruits in your diet as well as lentils and legumes is essential to avoid the risk of prostate related issues which can have a direct impact on your sexual function. Fish high in omega-3 fatty acids like mackerel and salmon should also be eaten often. Whole grain products though recommended in moderation are always better for our bodies than refined products.

Avoid fatty food and meat, products containing hydrogenated oils, processed food that tends to be rich in sodium as well as sodas and pasteurized dairy products. Include a healthy amount of chilli peppers in your diet as they’re known to have cancer inhibiting qualities. Saw Palmetto, nettle, green tea, kelp and pygeum are other foods that are beneficial to the prostate.

Diet, however, takes time to work. If you’re currently experiencing erectile dysfunction then buy Cialis to help see you through the short term.

Wrinkles, How to Avoid Them

by admin on July 22, 2009

eye9One of the major problems related to the skin which women above the age of 30 generally face is that of wrinkles. Anti wrinkle cream is the best solution to this problem. As women age, there is progressive loss of collagen leading to loss of elasticity of the skin. Over a period of time, the skin starts sagging. With this as the central issue, laboratories all over the world are continuously trying to formulate anti wrinkle creams and lotions. Some anti wrinkle creams claim to remove the dead cells on the surface of the skin so that the under lying new layers can come to the up, giving the skin a fresh look. Others claim to induce the formation of collagen, plumping up the skin, thus, smoothening out fine lines.

Women use these creams to reduce deep lines around the mouth area, frown lines and crow’s feet. The area around the eye, however, is very delicate. To use under eye serum or gel for this purpose is a good idea as these formulations are extremely light and will not cause puffiness.

The effectiveness of these creams depends on the different skin types but generally seem to work properly on all.
